1. Reservation & Booking Fee
All bookings require a reservation/booking fee to secure participation. The reservation fee is not the full tour price; remaining balances must be paid before departure on the tour date. Reservation fees cover operational and administrative expenses (staffing, scheduling, fuel planning, permits, equipment, insurance administration, logistics). Payments are non-refundable except where required by applicable law. Electronic payment, online booking, digital confirmation, or participation constitutes legally binding acceptance of these Terms.
2. Strict No Refund & Operational Change Policy
All sales are final. Refunds, compensation, credits, or reimbursements are not available for: change of mind; late arrival or no-show; personal reasons, illness, or injury; travel delays; sea, tide, or weather conditions; fear, discomfort, anxiety, or inability to participate; route modifications or shortened tours; mechanical issues or operational delays; safety-related cancellations or changes. Destinations, routes, stops, departure times, and itineraries are not guaranteed and may be changed, delayed, shortened, or canceled without notice for operational or safety reasons.
3. Pick-Up, Arrival & Safety Briefing
Complimentary transportation is available only from designated company service areas. Guests outside service areas must arrange their own transportation and arrive at least 30 minutes before departure for safety briefing, equipment fitting, identity verification, fitness assessment, and operational instructions. Participation is permitted only after completion of the mandatory safety briefing. Late arrival may result in denied participation without refund. Tours will not be delayed for late guests.
4. Passport Identification Requirement
All participants must provide a valid passport image or identification on the tour date for insurance, safety, legal compliance, and operational purposes. Failure to provide valid identification may result in denied participation without refund.
5. Age, Weight, Pregnancy & Fitness Requirements
Minimum participation age is 15 years old. Maximum combined rider weight is 170 kg per jet ski. Pregnant guests are strictly prohibited from participation. Guests must be physically and mentally fit to safely operate or ride marine equipment. The company may deny participation to any guest who appears medically unfit, mentally impaired, intoxicated, under the influence of drugs or impairing medication, or who cannot safely operate equipment. All operational and safety decisions are final.
6. Assumption of Risk & Liability Waiver
Jet ski and marine activities involve inherent risks including but not limited to: serious injury, permanent disability, drowning, death, collision, equipment malfunction, weather hazards, waves and currents, marine life, slippery surfaces, operator error, and other natural or operational risks. Guests voluntarily assume all risks associated with participation. To the maximum extent permitted by Thai law, guests release and hold harmless the company, owners, staff, guides, contractors, and partners from liability arising from participation.
7. Conduct, Harassment, Safety & Zero-Tolerance Policy
The company maintains a strict zero-tolerance policy toward abusive, unsafe, discriminatory, illegal, or inappropriate behavior. Strictly prohibited: verbal abuse, threats, or harassment; racism, sexism, hate speech, misogyny, homophobia, or discriminatory remarks; sexual harassment, inappropriate touching, or explicit comments; aggressive, violent, or dangerous conduct; excessive profanity or obscene gestures; bullying or intimidation; unsafe operation of equipment; ignoring staff instructions; participation under the influence of alcohol or drugs; illegal activity; damage or theft of property; dangerous speeding, collisions, stunts, or unsafe swimming; filming or photographing others in a threatening or inappropriate manner. The company may immediately refuse participation, remove guests from the tour, terminate participation, refuse future service, or contact police or authorities. No refunds or compensation will be provided. Guests are financially responsible for damage, rescue costs, legal claims, or operational disruption caused by their conduct.
8. Equipment Damage & Financial Responsibility
Guests are fully responsible for damage caused by negligence, reckless operation, collision, misuse, or failure to follow instructions. Repair, towing, rescue, recovery, replacement, operational, or retrieval costs remain the responsibility of the guest.
9. Personal Belongings & Electronics
The company is not responsible for loss, theft, water damage, or damage to phones, cameras, drones, jewelry, cash, or personal belongings. The company is not obligated to recover lost items from the sea.
